Bequest Language

A bequest gift can be a specific dollar amount or asset, a percentage or the entire residue of your property, restricted (to be used for a particular purpose), unrestricted (to be used for general purposes of NAFCEF), or a contingent gift (gift is made only if specific conditions occur, i.e., a spouse has died before the donor). In addition, your assets remain in your control and your gift can be changed at any time should your situation change.

A charitable bequest may be modified by a codicil. This supplement to a will may be more simple and economical than having a new will drafted.

Below is an example of how you may want to word your desire.

FIRST CODICIL TO LAST WILL AND TESTAMENT OF
_________________________

I, ____________________, of _______________County, Indiana, do make, publish and declare this as the First Codicil to my Last Will and Testament dated __________, 201_, attached hereto, and do by this Codicil amend my Last Will and Testament as follows:

FIRST: I hereby add as a separate paragraph to my Last Will and Testament the following ARTICLE ___, to read as follows:

I hereby give, devise and bequeath the specific sum of $__________ to THE NEW ALBANY FLOYD COUNTY EDUCATION FOUNDATION, current address 2813 Grant Line Rd. New Albany, IN 47150 or to its successor or, if none, to a local organization supporting k-12 education to be chosen by my Executor.

SECOND: In all other respects I hereby republish, redeclare, ratify and confirm my said Last Will and Testament dated __________, 201_.

IN WITNESS WHEREOF, I have hereunto set my hand and published and declared this as the First Codicil to my Last Will and Testament, dated __________, 20__ at __________County, Indiana, this _____ day of __________, 201_.

ATTESTATION AND DECLARATION OF WITNESSES

Each of us whose signature appears below, says and declares that, on this _____ day of __________, 201_, in the presence of each of us, ____________________ declared this instrument to be the First Codicil to his (er) Last Will and Testament, that (s)he executed it for such purpose, and requested that each of us sign said Codicil as attesting witnesses; that we have signed as attesting witnesses in his (er) presence and in the presence of each other; that we know his (er) and that (s)he appears to be of full age and of sound and disposing mind and memory and competent in every respect to make this Codicil to his Last Will and Testament and not under any restraint, duress or undue influence; each of us is over eighteen years of age and otherwise competent to be an attesting witness; and this certification is made at the request of ____________________ for the purposes of being presented to a court of competent jurisdiction to prove the foregoing First Codicil to the Last Will and Testament of ____________________.

Each of us further declares under penalty of perjury under the laws of the State of Washington that the foregoing declaration is true and correct.
